Acceptance of these terms

These terms are a binding agreement between you and Big Dawg software, LLC ("we", "us"), covering your use of Timepool. By creating a poll, responding to one, or otherwise using the site, you agree to them. If you don't agree, don't use the service.

You must be at least 13 years old to use Timepool. If you are under the age of majority where you live, you may use it only with the involvement of a parent or guardian.

What the service is

Timepool lets one person propose a range of days and hours, and lets anyone holding the resulting link record when they are free. We tally the responses and rank the times that work for the most people. That is the entire service. It is provided free of charge and funded by advertising.

No accounts, and what that means

There is no registration, no password and no identity verification. Access is controlled entirely by knowing a poll's link, and your ability to edit your own response or manage a poll you created depends on random keys held in your browser's local storage.

Some consequences worth being explicit about:

  • Display names are not verified. Anyone with the link can respond under any name. Do not treat a name in a poll as proof of who answered.
  • Losing your organizer key is final. We store only a hash of it. If you clear your browser data and don't have your organizer link, nobody — including us — can restore your control of that poll.
  • Anyone with the link can respond, edit their own answer, and see everyone else's. Sharing the link is the whole access decision.

Acceptable use

You agree not to:

  • Use Timepool for any unlawful purpose, or to harass, threaten, defame or impersonate anyone.
  • Submit content that is unlawful, abusive, obscene, or that infringes anyone's intellectual property or privacy rights.
  • Enter another person's personal information into a poll without a lawful basis for doing so.
  • Attempt to enumerate, scrape or access polls you were not given a link to.
  • Probe, scan, or test the vulnerability of the service, or breach or circumvent its security or rate limits.
  • Automate poll creation or responses, or otherwise place a load on the service that degrades it for others.
  • Interfere with the advertising on the site, or generate invalid ad traffic by any means.
  • Resell, sublicense or commercially exploit the service.

Your content

You keep whatever rights you already have in what you type. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display that content for the sole purpose of operating the service — that is, showing your poll to people who hold its link. This licence ends when the content is deleted. We claim no other rights over it and will not use it for anything else.

You are responsible for what you submit, including confirming you have the right to submit it. Please don't put sensitive personal information, credentials or confidential material into a poll.

Visibility and moderation

Polls are unlisted, excluded from search engines, and addressed by unguessable links — but they are not private in any stronger sense. Anyone holding a poll's link can see everything in it, including every respondent's name and availability, and can add or remove their own response. Share the link only with the people who should have that access.

We do not pre-screen content and have no obligation to monitor it. We may remove content, delete polls or block access at our discretion where we believe these terms or the law have been broken, or in response to a valid legal request.

Availability and data loss

Polls and every response in them are deleted automatically 60 days after the poll's last date, and may be lost sooner through failure, maintenance, migration or error. We offer no uptime commitment and may change, suspend or discontinue the service at any time.

Timepool is not a system of record. Once you've agreed a time, put it in your actual calendar.

Our intellectual property

The Timepool name, logo, site design and software are ours and are protected by intellectual property law. These terms grant you a limited, revocable, non-transferable licence to use the service as intended, and nothing more.

Advertising and third-party links

The site displays advertising supplied by third parties, and polls may contain links written by other users. We do not control, endorse or take responsibility for third-party content, products or websites, and your dealings with them are solely between you and them. Termination

You can stop using Timepool at any time; deleting your poll or your response ends the arrangement on your side. We may suspend or terminate access at any time, with or without notice, where we believe these terms have been broken. The sections on your content, disclaimers, liability, indemnification and governing law survive termination.

Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, that results will be accurate, or that data will not be lost.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Big Dawg software, LLC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, revenue, goodwill or business opportunity, arising out of or relating to your use of the service — including any missed, double-booked or mistaken appointment — whether based in contract, tort, negligence or any other theory, and even if we were advised of the possibility.

Our total aggregate liability arising out of or relating to the service will not exceed one hundred US dollars ($100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Indemnification

You agree to indemnify and hold harmless Big Dawg software, LLC from any claim, demand, loss or expense (including reasonable legal fees) arising out of content you submit, your use of the service, or your breach of these terms or of any law or third-party right.

Changes to these terms

We may update these terms. The date at the top of this page tells you when they last changed, and continuing to use Timepool after a change means you accept the revised version. If a change is material we will note it on the site rather than quietly editing the page.

Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts located there, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are a consumer resident in the EEA or UK, nothing here deprives you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings in your local courts.

If any provision of these terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
